Managing a Separation

 

In 2019 there were 3.4million cohabiting families in the UK, making up 17.9% of all families.  Couples who live together without being married generally have fewer legal rights – particularly if they didn’t produce any legal agreements before cohabiting.

As a result many couples who live together separate without using a solicitor because there’s no formal legal process to go through.  Despite this the practical and emotional journey can be very similar to managing a divorce.  Legal disputes can still arise over how to divide joint assets or possessions and arrangements for your children. ‘Separation’ simply means living apart and is different from filing for a legal separation or divorce. Whilst divorce is a complete dissolution of the marital state, legal separation allows you to live apart whilst remaining married and requires you to file a legal petition in the court.  Legal separation can take as long as divorce and cost just as much because it can involve a financial settlement and child arrangements.
